OPEN ONLY TO LEGAL RESIDENTS OF THE U.S., 18 YEARS OF AGE AND OLDER AS OF APRIL 28, 2008. VOID IN CANADA, PUERTO RICO, AND ALL OTHER U.S. TERRITORIES, U.S. MILITARY INSTALLATIONS IN FOREIGN COUNTRIES AND POSSESSIONS AND WHERE PROHIBITED BY LAW.
Promotion Period: The “New Hamsphire Send Us Your Photos Giveaway” (the “Giveaway”) begins at 12:01 a.m. Eastern Time (“ET”) on April 28, 2008 and ends at 11:59 p.m. ET on May 28, 2008 (“Promotion Period”). During the Promotion Period the drawing will be on or bout August 1, 2008April 15, 2007 to award the prizes as described more fully below. The entry period will begin at 12:01 a.m. ET on January 6, 2007 and end at 11:59 p.m. ET on March 31, 2007.
How To Enter: During the Promotion Period, visit insert url here and upload your photo(s). Entries must be complete in order to be eligible. No automated entries permitted. All entries must be received by 11:59 p.m. ET on May 28, 2008, to be eligible for the Drawing . No incomplete, forged or altered entries will be accepted. Limit one (1) entry per person, household or e-mail account per. Normal Internet access, phone charges and usage charges imposed by your online/phone service providers will apply. Entries will be declared to be made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet Access provider, Online Service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. All entries shall become the property of Sponsor. Personal Information collected in connection with this Giveaway will be used in accordance with the privacy policy found on the Website (http://www.thebalsams.com/PrivacyPolicy.aspx) and the permission granted by participants at the time of entry.
Prizes and Estimated Retail Value (“ERV”): The following prizes will be available for the winner: one (2) night stay for two (2) at The BALSAMS Grande Resort (ERV: $800). All hotel stays are based on double-occupancy. Hotel stays must be completed between September 1, 2008 through June 30, 2009 (excluding holidays). Failure by a winner to complete his/her stay between September 1, 2008 through June 30, 2009 shall constitute forfeiture of prize and no alternate winner will be selected. Prizes are nontransferable and no substitutions are allowed except by the Sponsor, who reserves the right to award a prize of equal or greater value if advertised prize is unavailable. Prize cannot be sold, refunded, commissioned, bartered, exchanged, or redeemed for cash. Sponsor and its agencies assume no responsibility or liability for damages, losses or injury resulting from acceptance or use of the prize. Winners of said prizes will receive the designated hotel stay only. Other costs not specified, including but not limited to, transportation fees, meal expenses, surcharges, taxes, tips and any other travel-related expenses, are the responsibility of the winner. Prizes are subject to change and availability, and advance reservations may be required.
Random Drawing: Potential winners will be selected in a random drawings from among all eligible entries received during the Promotion Period and randomly assigned to one of the prizes described above. The Drawing will be conducted on or about August 1, 2008, from among all eligible entries received during the Entry Period. Drawings will be conducted by MMG Worldwide Marketing, Inc., an independent organization whose decisions are final on all matters relating to the random drawings and random assignment of prizes. Odds of winning are dependent upon the number of eligible entries received during each entry period. Limit one prize per person. The potential winners will be notified by mail/e-mail within three (3) to five (5) business days of each drawing. Upon notification, potential winners will have two (2) weeks to claim their prize. Alternate winners will be selected if the individuals initially selected cannot be reached within that time period. ANY PERSON SELECTED AND NOTIFIED AS PRIZE WINNER WILL BE DEEMED A POTENTIAL WINNER PENDING VERIFICATION OF ELIGIBILITY AND COMPLIANCE WITH THESE OFFICIAL RULES.
General Rules: All Federal, state, local and municipal taxes and other governmental charges, if any, and all other costs and expenses associated with acceptance or use of the prizes or related to the prizes, not specified herein, are the sole responsibility of the individual winners. Potential winners will be required to execute and return an affidavit of eligibility and liability/publicity release, where legal, within ten (10) days of notification attempt or the prize will be forfeited and an alternate potential winner selected. If the prize winner is a minor in his/her state of residence, prize will be awarded in the name of parent or legal guardian, who will be required to sign all documents, fulfill all required conditions as set forth in these Official Rules, including accompanying minor on the trip. Return of any prize/prize notification as undeliverable for any reason, including but not limited to entrant providing an incomplete or invalid e-mail address, mailing address, spam or other filtering software present on entrant’s computer, will result in disqualification and the selection of an alternate potential winner. Acceptance of prize constitutes permission to use winner’s name, photographs, biographical information, voice, statements, or likeness for publicity or promotional purposes without further compensation and without the right to receive notice, review, or approval by prize winner and his/her parent or legal guardians, except where prohibited by law. By entering the Giveaway, entrant accepts and agrees to be bound by these Official Rules and the decisions of MMG and the Sponsor. Hotel stays may not be combined with any other offer. Certain additional restrictions and blackout dates may apply. Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Giveaway or website; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Sponsor and its agencies are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in the Giveaway which may limit the ability to participate or by any human error which may occur in the processing of the entries in the Giveaway. Sponsor is not responsible for any damage to entrant's computer in connection with accessing or downloading any information from Sponsor's website. Sponsor reserves the right to cancel the Giveaway if it becomes technically corrupted, and award a prize from eligible entries received prior to cancellation. Blackout dates may apply.
Eligibility: This Giveaway is open only to legal residents of the U.S., who are 18 years of age or older as of January 1, 2007. Employees and their families and members of household of DNC Parks & Resorts at the The Balsams, LLC. and Delaware North Companies Parks & Resorts, Inc.; HMA Marketing, Inc. d/b/a Hospitality Marketing Associates; their respective parent companies, affiliates, subsidiaries, and agencies, are not eligible to enter or win. This offer is void in Canada, Puerto Rico, and all other U.S. territories, U.S. military installations in foreign countries and possessions and where prohibited by law and subject to all federal, state, local, and municipal laws and regulations. The Giveaway will be governed by the internal laws of the State of New York, without regard to its conflict of laws principles. Force Majeure: The failure of Sponsor to comply with any provision of these Official Rules due to an act of God, hurricane, war, terror, fire, riot, earthquake, act of public enemies, actions of governmental authorities outside of the control of Sponsor or other force majeure event will not be considered a breach of these Official Rules.
Winners List: For the name of the winners, available after September 28, 2008 for the Drawing or send a self-addressed, stamped envelope to “SEND US PHOTOS Giveaway”, The BALSAMS Grande Hotel Resort, c/o Mr. Gary Armitage, 1000 Cold Spring Road, Dixville Notch, New Hampshire 03576. Winner list requests must be received by October 29, 2008. Residents of Vermont may omit return postage for winner list requests.
